TERMS of BOOKING

This is the TERMS OF BOOKING Agreement for Indiemusiciansshowcase.com. By using the services as provided by Indiemusiciansshowcase.com you agree to abide by all of the Terms and Conditions of this Agreement. If you do not agree to be bound by these Terms and Conditions, you may not use Indiemusiciansshowcase.com for any purpose. Indiemusiciansshowcase.com may amend this Agreement at any time by posting the amended terms on the Indiemusiciansshowcase.com website.
Eligibility. Indiemusiciansshowcase.com services are available only to individuals who are qualified to form legally binding contracts under applicable law. Without limiting the foregoing, our services are not available to minors. If you are a minor, you can use this service only in conjunction with the agreement and consent of your parents or guardians. If you do not qualify, please do not use our services.
Monetary. All prices are quoted in U.S. Dollars and must be paid in U.S. Dollars.
Payment. We use PayPal as the payment processor for our service. You do not have to have a PayPal account to use PayPal. You can pay using your credit card on the PayPal site.
Ticket Sales All ticket sales are final with no refunds or exchanges. The purchaser is responsible for the safe-keeping of all advance tickets. Lost advance tickets cannot be replaced.
Concerts. Indie Musicians Showcase does not directly control the performances that are provided by musicians and made available during our concerts. You agree to hold Indie Musicians Showcase harmless and not responsible for the performances provided by musicians at our Concerts. Bands performing at the Showcase are not under contract. Each band is responsible for its own arrangement and selection of all materials used on stage. Promoter is not liable for collecting royalty or purchasing license on copyrighted material for any organization.
Conduct. Indie Musicians Showcase concerts are family events and no alcohol, drugs or profanity are allowed. All attendees are expected to refrain from talking and causing any disruption during the concert. Violation of this conduct code will be reason for removal from the theater and/or non-payment of a performance fee.
Release. You agree to release Indiemusiciansshowcase.com (and our officers, directors, agents, subsidiaries, joint ventures and employees) from any claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with your performance and/or attendance at an event promoted by Indie Musicians Showcase.
Operational Failure. You agree to hold Indiemusiciansshowcase.com and its parent, subsidiaries, officers, affiliates, directors, agents, and employees, harmless from any claim for damages or liability which may arise from any operational failure of the theater equipment and/or public utilities.
Performance Fee. A Performance fee shall be paid to each band plus an additional fee for each ticket purchased that the band was directly responsible for selling.
Bands Bands must have a minimum of three members to perform and the music presented must be live with no tracks.
Governing Law and Consent to Jurisdiction and Venue:
Governing Law. This agreement, and any dispute arising out of the TERMS and CONDITIONS Agreement, shall be governed by the laws of the State of Tennessee.
Consent to Jurisdiction and Venue. Each party hereby irrevocably consents to the exclusive jurisdiction and venue of any state court located within Blount County, State of Tennessee, in connection with any matter arising out of this Agreement or the transactions contemplated under this Agreement.
Consent to Service. Each party hereby irrevocably:
(i) agrees that process may be served on it in any manner authorized by the Laws of the State of Tennessee, and;
(ii) waives any objection which it might otherwise have to service of process under the Laws of the State of Tennessee.
