TERMS of BOOKING

This is the TERMS OF BOOKING Agreement for IndieMusiciansShowcase.com. By using the services as provided by IndieMusiciansShowcase.com you agree to abide by all of the Terms and Conditions of this Agreement. If you do not agree to be bound by these Terms and Conditions, you may not use IndieMusiciansShowcase.com for any purpose. IndieMusiciansShowcase.com may amend this Agreement at any time by posting the amended terms on the IndieMusiciansShowcase.com website.
Eligibility. IndieMusiciansShowcase.com services are available only to individuals who are qualified to form legally binding contracts under applicable law. Without limiting the foregoing, our services are not available to minors. If you are a minor, you can use this service only in conjunction with the agreement and consent of your parents or guardians. If you do not qualify, please do not use our services.
Monetary. All prices are quoted in U.S. Dollars and must be paid in U.S. Dollars.
Payment. We use PayPal as the payment processor for our service. You do not have to have a PayPal account to use PayPal. You can pay using your credit card on the PayPal site. PayPal processing fees will be added as a separate charge at check out and labeled as a Service Fee and Administration Fee.
Ticket Donations. All ticket donations are final with no refunds or exchanges. The donor is responsible for the safe-keeping of all advance donation tickets. Lost advance donation tickets cannot be replaced.
Showcase Events. Indie Musicians Showcase does not directly control the performances that are provided by singers and musicians and made available during our event. You agree to hold Indie Musicians Showcase harmless and not responsible for the performances provided by performers at our Showcase events. Singers and musicians performing at the Indie Musicians Showcase are not under contract. Each performer is responsible for their own arrangement and selection of all materials used on stage.
Conduct. Indie Musicians Showcases are family events and no alcohol, drugs or profanity are allowed. All attendees are expected to refrain from causing any disruption during the event. Violation of this conduct code will be reason for removal from the facility.
Release. You agree to release Indie Musicians Showcase.com (and our officers, directors, agents, subsidiaries, joint ventures and employees) from any claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with your attendance at an event promoted by Indie Musicians Showcase.
Operational Failure. You agree to hold Indie Musicians Showcase.com and its parent, subsidiaries, officers, affiliates, directors, agents, and employees, harmless from any claim for damages or liability which may arise from any operational failure of the venue equipment and/or public utilities.
Governing Law and Consent to Jurisdiction and Venue:
Governing Law. This agreement, and any dispute arising out of the TERMS and CONDITIONS Agreement, shall be governed by the laws of the State of Tennessee.
Consent to Jurisdiction and Venue. Each party hereby irrevocably consents to the exclusive jurisdiction and venue of any state court located within Blount County, State of Tennessee, in connection with any matter arising out of this Agreement or the transactions contemplated under this Agreement.
Consent to Service. Each party hereby irrevocably:
(i) agrees that process may be served on it in any manner authorized by the Laws of the State of Tennessee, and;
(ii) waives any objection which it might otherwise have to service of process under the Laws of the State of Tennessee.
